DOT D & A SUPPLEMENTAL GUIDANCE FOR SAPS

The DOT D & A Policy and Compliance has provided supplemental guidance for SAP’s per the emergency.  First, it will “allow SAPs to conduct a remote face-to-face evaluation and assessment while the policy is in effect.”  In-person evaluations may still be performed.

If the evaluation is done remotely, the format of he assessment should be documented in the final report.  The SAP should use real time, two-way audio and visual communication and interaction.  The SAP should evaluate the quality of the technology insofar as the communication.  “You may only utilize the technology if your State-issued license authorizes you to do so and within the parameters of that authority.”

The supplemental guidance also provides that if the service agent is not able to fulfill the re-qualification due date during the period, it will not consider it a non-compliance for purposes of starting a public interest exclusion against the service agent.

STATE-BY-STATE TEMPORARY CHANGES

DRIVERS GOING TO NY—NO REQUIREMENT TO SELF-ISOLATE

Last Saturday I received an email that a driver had gone for his physical that day and the doctor, upon hearing he had been in and out of NYC told him to self-isolate for 14 days.  This is not correct.

Per the guidance issued Friday by the FMCSA, it stated, “The CDC’s March 28, 2020 Travel Advisory for New York, New Jersey and Connecticut, which urged residents of those States to refrain from domestic travel for 14 days, expressly excluded “employees of critical infrastructure industries, including but not limited to trucking.”  The CDC Advisory noted that these employees ‘have a special responsibility to maintain normal work schedules.’”

STATE AND LOCAL GOVERNMENTS

The FMCSA has issued a statement with regard to the state and local shelter-in-place orders for consideration of these government entities in issuing such orders.  These include Homeland Securities identification of essential workers and CDC guidance for drivers.
